According to articles 87 to 98 of the Industrial Property Law, industrialists, merchants, or service providers may use trademarks; however, an exclusive right is obtained by registration of a trademark with the Mexican Institute of Industrial Property (IMPI).

The IMPI is the body empowered to carry out the registration of a trademark and the publication of a trade name. Any distinctive sign described in the Industrial Property Law (LPI) may be registered with the IMPI, which include the following:

  • Trademarks
  • Commercial Notices
  • Trade Names
  • Collective and Certification,
  • Well-known and famous trademarks

The importance of obtaining a registration for these signs is based on the fact that it produces effects against third parties, in order to avoid the risk of confusion for the consumer and the use of a trademark to favor another.

By registering, the status of owner will be registered. Furthermore, a registration title is issued, which gives the right to use it exclusively throughout Mexico (optional international registration) and prevents anyone from using the trademark without corresponding authorization.
